Terms of Service

These Terms of Service ("Terms") govern your use of the AquaEdit mobile application ("App") provided by EIKO Consulting, LLC ("we", "our", "us").

1. Acceptance of Terms

By creating an account and using AquaEdit, you agree to these Terms. If you do not agree, do not use the App.

2. Account

You must create an account to use AquaEdit. You are responsible for maintaining the security of your account. You must be at least 13 years old to use the App.

3. The Service

AquaEdit uses AI to enhance underwater photographs. Results may vary depending on the quality and content of the original photo. We do not guarantee specific results.

4. Credits and Purchases

New accounts receive 5 free enhancement credits. Additional credits may be purchased through in-app purchases. Credits are non-transferable and non-refundable except as required by applicable law or Apple's refund policies. Unused credits do not expire.

Prices are in USD and may change. Purchases are processed by Apple and subject to Apple's terms.

5. Acceptable Use

You agree not to:

Use the App for any illegal purpose
Upload content that violates others' rights
Attempt to circumvent credit limits or abuse the service
Reverse engineer or attempt to extract the AI model or API keys
Use automated tools to access the service at excessive rates

6. Your Content

You retain ownership of photos you upload. By using the App, you grant us a limited license to process your photos for the purpose of providing the enhancement service. We do not claim ownership of your photos or enhanced results.

7. AI-Generated Content

Enhanced photos are generated by AI and may contain artifacts or unexpected modifications. You are responsible for reviewing enhanced results before sharing or publishing them.

8. Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.

Our total liability shall not exceed the amount you paid for credits in the 12 months prior to the claim.

9. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Unused credits are forfeited upon account deletion.

10. Changes to Terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, USA.
